Last week Democrats on the New York State Board of Elections voted to cancel the state’s primary due to coronavirus fears.
But now the New York State Democratic presidential primary will go on.
Former presidential candidate Andrew Yang and other voters filed a lawsuit against the state Board of Elections.
Tuesday a judge ruled the state election will take place on June 23 as planned.
The board also removed the candidates who suspended their campaigns from the ballot.
That left former vice president Joe Biden the only name.
Board members therefore argued there was no reason to hold a primary with one candidate.
But the judge also ruled to restore the former presidential candidates to the ballot.
States including New York have postponed presidential voting to curb the spread of Covid-19 and some have pushed to expand voting by mail.
